Terms of service for MAMAJI's IT solutions

1. Acceptance of Terms

By accessing and using the services provided by MANSA PRODUCTS, operating under the brand name "MAMAJI" ("Company," "we," "our," or "us"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

MAMAJI provides IT services including but not limited to:

  • Web and mobile application development
  • Cloud computing and DevOps services
  • Cybersecurity and compliance solutions
  • Automation and integration services
  • Data analytics and business intelligence
  • Managed IT support and maintenance

3. User Responsibilities

3.1 Accurate Information

You agree to provide accurate, current, and complete information about yourself and your business as prompted by our service forms.

3.2 Compliance with Laws

You agree to comply with all applicable local, state, national, and international laws and regulations in your use of our services.

3.3 Prohibited Uses

You may not use our services for any unlawful purpose or to solicit others to perform unlawful acts. You may not violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances.

4. Service Level Agreement

4.1 Availability

We strive to maintain 99.9% uptime for our services, excluding scheduled maintenance windows and circumstances beyond our control.

4.2 Support

Technical support is available during business hours (9 AM - 6 PM, Monday to Friday, IST) via email and phone. Emergency support may be available outside business hours for critical issues.

5. Payment Terms

5.1 Pricing

Service pricing is as agreed upon in individual service agreements. All prices are in Indian Rupees (INR) unless otherwise specified.

5.2 Payment Schedule

Payment terms will be specified in individual service agreements. Generally, we require:

  • 50% advance payment for new projects
  • Remaining 50% upon project completion
  • Monthly billing for ongoing services

5.3 Late Payments

Late payments may incur a 1.5% monthly service charge. Services may be suspended for accounts with payments overdue by more than 30 days.

6. Intellectual Property

6.1 Client Ownership

Upon full payment, clients own all custom-developed code, designs, and deliverables created specifically for their project.

6.2 Company Rights

MAMAJI retains rights to:

  • Pre-existing intellectual property and methodologies
  • General knowledge and skills gained during project execution
  • Open-source components and third-party libraries

7. Confidentiality

Both parties agree to maintain the confidentiality of all proprietary and confidential information disclosed during the course of business. This obligation survives termination of the service agreement.

8. Limitation of Liability

To the maximum extent permitted by law, MAMAJI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

9. Indemnification

You agree to indemnify and hold harmless MAMAJI from any claims, damages, or expenses arising from your use of our services or violation of these terms.

10. Termination

10.1 Termination by Client

Clients may terminate services with 30 days written notice. Payment for work completed up to the termination date is due immediately.

10.2 Termination by Company

We may terminate services immediately if:

  • Payment is overdue by more than 30 days
  • Client violates these terms and conditions
  • Client engages in illegal or unethical activities

11. Data Protection

We are committed to protecting your data in accordance with our Privacy Policy and applicable data protection laws, including GDPR and the Information Technology Act, 2000 (India).

12. Force Majeure

Neither party shall be liable for any failure or delay in performance due to circumstances beyond their reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, or government actions.

13. Dispute Resolution

Any disputes arising from these terms shall be resolved through:

  1. Good faith negotiations between the parties
  2. Mediation if negotiations fail
  3. Arbitration in Chennai, Tamil Nadu, India, if mediation fails

14. Governing Law

These terms shall be governed by and construed in accordance with the laws of India. Any legal action shall be brought in the courts of Chennai, Tamil Nadu.

15. Modifications

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting on our website. Continued use of our services constitutes acceptance of the modified terms.

16. Severability

If any provision of these terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These terms, together with any service agreements and our Privacy Policy, constitute the entire agreement between you and MAMAJI regarding the use of our services.
